Judicial Capacity Building

As part of its ongoing support to the Government of Ukraine in their effort to adopt legislation and implementing measures for intellectual property enforcement as called for in the WTO TRIPS Agreement, the Commercial Law Development Program of the U.S. Department of Commerce held three-day workshop for district and appellate court judges representing 17 Ukrainian Oblasts.

Effecting Cooperation between Ukraine State Customs Service and the Ministry of Interior

As part of its ongoing support to the Government of Ukraine in their effort to adopt legislation and implementing measures for intellectual property enforcement as called for in the WTO TRIPS Agreement, CLDP held a workshop to increase the capacity within the State Customs Service of Ukraine to implement practical measures to better enforce IP protection and to improve cooperation between the State Customs Service of Ukraine and the Ministry of Interior of Ukraine.

CLDP coordinated a consultative visit to Washington, DC for the Ukraine WTO Information Processing Center. The delegationmet with key USG officials to discuss its WTO obligations.

Workshop on the Coordination of IP Border Enforcement II Russia-Ukraine

Both Russia and Ukraine have recently enacted and put into force a Customs Code that requires protection of intellectual property as called for in the WTO TRIPS Agreement. Working with the Ukrainian and Russian Federal Customs Services, CLDP conducted a technical assistance program on the structure of efficient IP border enforcement, risk management (including targeting shipments), making infringement determinations and suspending release of goods, and the operational components of ex officio authority.

Workshop on IP Appellate Proceedings II: State Department of Intellectual Property of Ukraine

An integral part of CLDP’s assistance is the reform of Ukraine’s intellectual property (IP) regime. At the request of the State Department of Intellectual Property of Ukraine (SDIP), CLDP, in coordination with the U.S. Patent and Trademark Office (USPTO), held a U.S.-based consultation for SDIP officials in November 2005 on the U.S. appellate process for patent and trademark appeals. The program sought to acquaint Ukrainian IP officials with the substantive and administrative principles and processes of IP appellate proceedings. Building upon the November 2005 consultations, CLDP and USPTO officials traveled to Ukraine to conduct exercises and mock trials with a larger group of Ukrainian IP officials.

SDIP Appellate Proceedings Workshop

CLDP conducted a program for Ukrainian intellectual property officials. The program, entitled "U.S. Consultations on Intellectual Property Appellate Proceedings: Ukraine State Department of Intellectual Property (SDIP)" sought to acquaint Ukrainian intellectual property officials with the substantive and administrative principles and processes of intellectual property appellate proceedings."

Russian and Ukraine - Border Enforcement Officials Workshop

As part of CLDP's ongoing support of Russia and Ukraine's efforts to make the protection of intellectual property rights under their Commercial Codes more compliant with the TRIPS Agreement, CLDP conducted a five-day workshop for Russian and Ukrainian border enforcement officials nominated by the Russian and Ukrainian State Customs Services.

Ukraine Customs Valuation II Training

Two U.S. Customs officials conducted the training – a continuation of a program conducted in December, 2002, on the methodology of valuation procedures – for twenty Ukrainian customs officials having senior responsibility for valuation at their respective border entry points.
