CLDP Hosts Consultation on Customs Valuation Measures

On November 19th, CLDP hosted a virtual consultation to discuss Afghanistan’s Customs Act and Customs Valuation Procedures. Participants from the U.S. included officials from the United States Trade Representative (USTR), United States Customs and Border Protection (CBP), Departments of State, Department of Treasury, USAID, and the International Trade Administration (ITA). Participants from Afghanistan included officials from the Legal Board of the Ministry of Finance (MoF), the Office of the Chief Legal Advisor to the President, Afghanistan’s Customs Department, and the Ministry of Industry and Commerce. This consultation was a direct request from the Government of Afghanistan as a follow-up to a review conducted by U.S. customs experts on both customs valuation measures. In April, as a request from the Afghan mission in Geneva, CLDP translated Afghanistan’s Customs Valuation Procedures and Customs Act from Dari to English. CLDP then coordinated their submission to the WTO Secretariat and shared the documents with experts from CBP and USTR for their review. After an in-depth review of both measures, the experts consolidated a list of questions and comments that CLDP shared with the Legal Board of the Ministry of Finance (MoF) in Afghanistan. The officials from the MoF formally responded to the questions and requested CLDP to create a working group to have in-depth consultations on how to assist Afghanistan in amending the legal documents so that they meet their obligations to the WTO’s Agreement on Customs Valuation. The meeting was both productive and engaging. Experts discussed the parts of the legal text that were inconsistent with Afghanistan’s commitments to the WTO and put together an action-plan for incorporating the proposed changes. Officials from Afghanistan also provided an update on the status of the amendments and gave a detailed description of the challenges they face in both passing the relevant legislation and implementing it at the borders. The meeting also helped facilitate inter-ministerial coordination in Afghanistan, which has been a significant challenge for our counterparts who have been working on his initiative. CLDP will host a follow-up meeting with the same officials within the next month. These series of consultations will assist Afghanistan in meeting the requirements set out in the WTO’s Agreement on Customs Valuation and will help Afghanistan incorporate valuation methods that are fair, transparent, and in line with international standards.
