Kuwait: CLDP Advocates for Kuwait Arbitration Law Reform

On February 6, CLDP staff and international dispute resolution experts from the American Arbitration Association and the International Chamber of Commerce met with representatives of the Kuwait Council of Ministers Department of Legal Advice & Legislation (“the Department). CLDP advocated for reform in the current legal regime governing alternative dispute resolution (ADR) in Kuwait. The Department was encouraged to adopt a new arbitration law to not only keep pace with international standards, but also to keep pace with recent arbitration law developments in the Gulf Cooperation Council (GCC). CLDP pledged to share experience with other GCC arbitration law developments with the Department. Over the past several years, CLDP has collaborated with Bahrain, Qatar, Saudi Arabia, and the UAE in modernizing their arbitration laws. In Kuwait, CLDP addressed portions of the Kuwait arbitration law that are outdated for modern commercial transactions. The current Kuwait arbitration law dates to 1960.  CLDP also advocated for changing the Kuwait arbitration law to empower international companies in contracts in Kuwait. With a modernized ADR regime in Kuwait, foreign companies would be encouraged to partner with Kuwaiti companies - increasing technology and knowledge transfer to the Kuwaiti economy. Representatives of the Department welcomed CLDP collaboration and outlined a legislative strategy by which Kuwait could update its current ADR legal regime. Over the coming months, CLDP will provide guidance to the Department in this legislative endeavor. With successful collaboration in recent years in Bahrain, Qatar, Saudi Arabia, and now Kuwait, CLDP has been a principal participant in modernizing international ADR in the GCC region that will benefit local and US companies alike.
