On May 24-25, 2023, in coordination with Georgia’s Business Rehabilitation and Insolvency Practitioners Association (BRIPA) and USAID, CLDP cohosted and joined the “Challenges of Modern Insolvency Law” Conference in Tbilisi, Georgia. The event brought together Georgian insolvency practitioners from Georgia to hear from international and regional experts. CLDP sponsored the participation of the Honorable Katharine Samson, United States Bankruptcy Chief Judge in the Southern District of Mississippi to participate in a panel discussion with Georgian and international judges. Participants also discussed the findings from two previous BRIPA/CLDP organized Working Group meetings on such issues as initiating proceedings, conducting an business viability test on companies entering bankruptcy and reorganization, endorsing a rehabilitation plan, and “cram down” procedures. A healthy insolvency regime can thus promote access to finance, entrepreneurship, and innovation by reorganizing viable companies in financial distress, liquidating non-viable companies in a fair and transparent manner, and maximizing returns to creditors and investors.
