CLDP Hosts Workshop on Adjudication of Bankruptcy Cases for BiH Judges

CLDP, in partnership with the Public Institution Centre for Judicial and Prosecutorial Training of FBiH, held a workshop on Adjudication of Bankruptcy Cases in Sarajevo, BiH for approximately 25 BiH judges. The two-day program included presentations, country-specific case studies, and examples from real practice on BiH registration requirements for commercial companies, bankruptcy cases and processes in the US, preconfirmation issues and case management tools, reorganization and liquidation considerations, and international elements in bankruptcy cases.

This program was part of the Judicial and Prosecutorial Center’s annual curriculum and thus incorporated BiH trainers and topics most relevant to BiH judges. New York U.S. Bankruptcy Court Judge Elizabeth Stong led the workshop which also included Municipal Court of Zenica Judge Ramo Ljevaković, Municipal Court of Sarajevo Judge Hakija Zaimović, and University of Mostar Professor Dr. Edin Rizvanović. Participants not only heard from a US Federal Bankruptcy Judge and local BiH judges but also took part in a case study that required them to split into groups and analyze a bankruptcy case from the viewpoint of the bank/creditor, the company owner, the company’s employees, and a judge. The speakers took the opportunity to highlight similarities and differences between US and BiH bankruptcy proceedings and legislation. Through CLDP’s ongoing program of judicial capacity building, BiH judges will gain the skills necessary to fairly, efficiently, and effectively adjudicate salient topics related to international commercial disputes.
