Jordan: Workshop on Adjudication of Disputes Related to International Contracts and Letters of Credit

Thanks to the 3-day, CLDP organized workshop, three main results were achieved. First, the Jordanian judges, all of whom adjudicate commercial cases, now understand how foreign arbitral awards can be enforced in Jordan. Secondly, the Jordanian judges are now familiar with the tenets of “Lex Mercatoria”. Finally, and this is the most important outcome, events like this workshop contribute to the independence of the local judiciary in three ways: By having to make decisions on case studies under the mentoring of a U.S. judge, the local judges gain expertise and self-confidence. Moreover, given the theme of the workshop, the Jordanian judges came away from it with a clear understanding that Jordan’s long-term interests in a global economy require that its judges abide by the principles “Lex Mercatoria”, and, also, that they enforce foreign arbitral awards to foreign firms, even though, in the short term, this might penalize Jordanian firms.
