On November 29-30, CLDP, in cooperation with the Moroccan judiciary, conducted a workshop in Casablanca on best practices in court supervision of bankruptcy procedures and developing resources to improve implementation. Speakers, including U.S. Federal Bankruptcy judges and a Federal Judicial Center bankruptcy practitioner, presented U.S. best practices in the restructuring of failing businesses, the critical elements to a successful restructuring process, and lessons learned from specific cases. Attended by Moroccan public prosecutors, judges, and trustees, the workshop also provided an opportunity for stakeholders to exchange experiences of recent bankruptcy cases and identify gaps in the current law that could be addressed through amendments to the current legislation or through official guidance in a bench book. CLDP’s work in in Morocco for the last several years has aimed to incorporate U.S. and international best practices in the bankruptcy framework and help the judiciary finalize a bench book to assist in consistent and predictable application of the provisions of the bankruptcy law.
