Negotiations in Energy and Minerals Handbook – Now Available

Why Negotiations? 

For over thirty years, CLDP has worked with governments to achieve economic growth through improvement of laws and regulations. Through our work, we have seen the impact of negotiations as a tool to advance the development of commercial law and frameworks that govern business relationships, especially those that benefit U.S. interests.  

This handbook will introduce the foundational principles of negotiation and provide practical exercises on rules governing investments in energy and minerals. Exercises in this handbook have been utilized internationally and have improved the skills of government and industry stakeholders engaged in the commercialization of energy and mineral resources.  

About the Handbook 

The Negotiations in Energy and Minerals Handbook was created using the Book Sprints method. It presents scored and unscored exercises for two-party or multi-party negotiations, facilitator instructions, and target objectives applicable to energy and mineral sector negotiators. This handbook is a reflection of the strategic engagement that CLDP has done on energy and minerals in partnership with various federal agencies, the U.S. judiciary, the private sector, and more. The content is relevant globally, but particularly useful to countries with a need to commercially develop their power, oil and gas, and mining sectors.  

Overview of Each Chapter  

CLDP will also release brief presentations to accompany a general overview of each chapter of the book below:

Chapter 1: Negotiating Best Practices  

Provides an overview of negotiation best practices, including a negotiations exercise to illustrate how these apply.  

Chapter 2: Efficiency in Gas Operations 

Contains two negotiations related to oil and gas rulemaking and import-export regulation.  

Chapter 3: Carbon Capture, Utilization, and Storage 

Offers three negotiations on subnational vs. national government regulation, regional, and RD&D competition negotiations. 

Chapter 4: Power 

Proposes two exercises on cross-border project development and private investment in transmission.  

Chapter 5: Mining 

Presents two negotiations on community benefit agreements and mining regulation drafting.
