Ukraine: Best-Value and Contract Types in Public Procurement

From June 30 to July 2, CLDP led a procurement-focused program in collaboration with SI Professional Procurement, a GOU entity leading advances in procurement practices across GOU ministries and state-owned entities, and the Ministry of Economy Public Procurement Department. This effort brought U.S. procurement experts to Kyiv to engage with Ukrainian counterparts on international best practices in public procurement, with a focus on transparency, competitiveness, alignment with global standards, and best-value procurement analysis/non-price criteria (NPC), which can open the door to U.S. bidders and prevent lowest-cost bidders from dominating Ukrainian procurements. During the program, CLDP focused on contract types and on designing, applying, and assessing best-value/non-price criteria through a practical exercise in which contracting authorities actively participated. Additionally, in light of the new public procurement law that was signed by President Zelenskyy in June, CLDP supported the Ministry of Economy and SI Professional Procurement in discussions related to the development of secondary legislation. CLDP also met with ProZorro to discuss how guidelines or templates, aligned with the anticipated secondary legislation, could be built into or referenced through the ProZorro system to help contracting authorities apply best-value procurement in practice.
