CLDP and USPTO organized a two-day workshop for 25 judges, utilizing expertise from the U.S. Judiciary, USPTO, CLDP, the U.S. Department of Justice, the State Department of Intellectual Property of Ukraine, and the IPR Enforcement Manual. The workshop provided an overview of international agreements on IPR, including the TRIPS agreement, on the international experience of enforcement of IPR, and on Ukrainian civil and criminal procedure pertaining to IP cases. In addition to the use of customized case studies to focus on certain procedural obstacles to effective IP enforcement, this workshop utilized, as a primary resource, the IPR Enforcement Manual prepared by officials of the State Department of Intellectual Property of Ukraine with the support of CLDP. Facilitators and presenters included international and Ukrainian judges and other IP experts. As result of this workshop, the Ukrainian judiciary expanded upon the skill and knowledge level to understand the underlying rationale of IP legislation, and to handle problematic IP adjudication issues, and thereby to provide more fair, effective and efficient adjudication of IP cases in Ukraine.
