Workshop on E-Commerce Fundamentals and Regional Perspective

In September 2006, CLDP in conjunction with the American Bar Association, the Arab Council for Judicial and Legal Studies, and the Bahrain Ministry of Justice presented a regional conference focused on training judges regarding the adjudication of electronic commerce disputes. Judges from 13 countries were represented, including representatives from Algeria, Bahrain, Egypt, Iraq, Jordan, Kuwait, Lebanon, Morocco, Oman, Palestine, Saudi Arabia, United Arab Emirates, and Yemen. The program was a significant success, particularly in the effectiveness of the program format, which was designed based upon CLDP experience in previous conferences in the Gulf. In this program, judges were separated in break out sessions wherein judges reviewed hypothetical case studies and were required to present their decisions regarding electronic commerce disputes. The judges were earnestly involved in the case study adjudications and took full advantage of the opportunity to practice adjudicating such cases with their peers. According to program evaluations, the training sessions were a significant success, with judges rating the conference overall above 8 on a scale of 1 to 10. CLDP plans to continue to provide judicial training sessions based upon the break out case study method, using case studies established by CLDP to educate judges regarding the appropriate adjudication of complex commercial transactions.
