Workshop on Mining Procurement

On March 21-22, 2018 CLDP, in cooperation with U.S. Embassy Pristina, conducted its initial workshop on Mining Tendering and Private Public Partnership in Pristina, Kosovo. This workshop was a direct response to recent developments within Kosovo to amend the Kosovo Mining Law (2013) to stream mining licensing and attract greater foreign investment in the mining industry.  Specifically, draft amendments to the law, led by Kosovo’s Independent Commission for Mines and Minerals (ICMM) addressed streamlining procedures with respect to special zones of interest.  The GOK has identified 11 special zones of interest that it hopes to develop mining infrastructure, however, many of these zones have remained undeveloped for nearly 10 years. CLDP’s workshop addressed two specific ways to develop mining in Kosovo.  First, the workshop addressed international best practices in mining tendering, including tendering processes, challenges to the bid process, dispute resolution and arbitration.  CLDP mining law experts gave a comparative overview of various case studies of countries who have successfully and unsuccessfully tendered mining projects. CLDP experts also discussed how Private-Public Partnerships (PPPs) are utilized as one vehicle to attract foreign investment in the mining industry and promote economic development of the private sector in Kosovo.  CLDP experts also included a hypothetical case study of the Karaqa zone, located in northern Kosovo, as one of the 11 special zones of interest under consideration for a mining tender by GOK during the course of the workshop.
