CLDP brought together about 60 practicing lawyers, international and Ukrainian arbitration/mediation experts, industry representatives, judges, and government officials for a three-day workshop May 20-22 in Kyiv on the Use of Alternative Dispute Resolution for Commercial Disputes. Participants discussed the legislation, institutional capacity, and international best practices surrounding the development and utilization of alternative dispute resolution methods, including negotiations, consultations, mediation and arbitration in Ukraine.
The workshop focused on: a) the need for promotion of mediation and arbitration as alternative dispute resolution methods; b) numerous practical aspects of successfully utilizing mediation and arbitration to resolve disputes, c) advantages of applying to international institutions for mediation and/or arbitration d) negotiation and consultation techniques and procedures ensuring mutually beneficial outcomes.
This program will result in an the improved capacity of Ukrainian government officials and private sector to develop, implement, and utilize ADR (based on international best practices) in Ukraine, a reduction in the backlog of cases in the judicial system, and an improved effectiveness and efficiency in Ukrainian commercial dispute resolution will be achieved.
