Dominican Republic: Workshop for Procompetencia, Judges and Prosecutors on Combatting Collusion in Public Procurement

On May 24, CLDP, in collaboration with USAID DR and the Dominican Republic’s Competition Authority (Procompetencia) conducted a workshop for judges and prosecutors on detecting, investigating and prosecuting anti-competitive practices in the public procurement. The workshop included opening remarks from the General Counsel of the US Department of Commerce, Leslie Kiernan, who spoke about the damaging impact that procurement collusion can have on the economic development of a country and the importance of collaboration between the regulatory, investigative and prosecutorial agencies. The workshop also featured presentations by experts from the US Department of Justice’s Procurement Collusion Strike Force who provided best practices for conducting investigations, gathering evidence and incentivizing whistleblowers. During the workshop, Procompetencia announced that they had initiated 13 investigations of alleged procurement collusion and six of those investigations were based on whistleblower complaints. Under the DR’s current competition law, Procompetencia must have the support of a prosecutor for each of its collusion investigations and courts must approve warrants for searches, however Procompetencia often faced obstacles in obtaining their support for investigations. As a result of the workshop, prosecutors and judges have a better understanding of both Dominican competition law and international best practices, which will improve future investigations. This workshop was part of CLDP’s multi-phase programming, funded by USAID DR, to strengthen the integrity of the public procurement system.
