On December 6-7, 2018, in coordination with the Dominican General Directorate for Public Contracting (DGCP) and the National School of the Judiciary, CLDP led a workshop on best practices in adjudicating bid protest cases for approximately 20 judges and support staff of the Superior Administrative Court and the Supreme Court in Santo Domingo, Dominican Republic. A judge from the U.S. Court of Federal Claims and a senior procurement analyst from the U.S. Department of Veterans Affairs gave an overview of the bid protest system in the United States and explored practical considerations from a government agency perspective before moving into an in-depth review of bid protest procedures before and after the adjudication of government contracts. Representatives from the DGCP complemented the information imparted by the U.S. experts by giving an overview of the Dominican system for bid protests, allowing participants to compare the processes for protesting the award of government contracts in the two countries. This comparative exercise culminated in a practical case study based on an actual case brought before the U.S. Court of Federal Claims, in which the Dominican judges and support staff considered the case and debated how it would be adjudicated under U.S. law versus Dominican law. This comparison is especially useful as the Dominican Republic is drafting a new government procurement law, and the workshop formed part of CLDP’s ongoing engagement with the Dominican judiciary. This engagement contributes to CLDP’s goal of improving the fairness and efficiency of the government procurement system in the Dominican Republic and will continue for the next two years under USAID’s extension of CLDP’s procurement transparency initiative in the Dominican Republic.
