Judicial Capacity Building Program on IP Law and International Commercial Arbitration

From April 25-April 30, 2011, CLDP conducted a Judicial Enforcement of Intellectual Property Rights and International Commercial Arbitration Program at Pakistan’s Federal Judicial Academy in Islamabad, Pakistan for a group of 30 Civil Judges and District and Sessions Judges.  CLDP’s program coincided with Pakistan’s National Judicial Conference held at the Pakistan Supreme Court.  The U.S. delegation, led by Attorney-Advisor Joe Yang, attended the last day of the conference and listened to a closing summary delivered by Pakistan Supreme Court Chief Justice Iftikhar Muhammad Chaudhry.  Over the course of CLDP’s program, the U.S. delegation attended two separate meetings with Chief Justice Chaudhry.  Chief Justice Chaudhry announced to the group that this was the first year that an intellectual property working session was placed on the conference agenda.  The Chief Justice explained that he placed this working session on the agenda as a direct result of Pakistan Supreme Court Justice Mian Shakirullah Jan’s participation in a CLDP IP program conducted in Washington, D.C. last fall.

The IP segment of CLDP’s program commenced on April 25 and concluded on April 26, 2011 and included topics such as Patents, Copyright and Trademark Infringement, Economic and Health/Safety Risks of Counterfeiting, Civil Remedies, Compensation and Remedies in Civil Cases and Deterrent Value of Civil and Criminal Penalties. The Honorable Morrison C. England, Jr., United States District Court, California, Eastern District, USPTO Attorneys Scott Baldwin and Kalpana Reddy and DOJ Attorney Philip Guentert served as the experts for the IP segment.  On the first day of the program, CLDP was informed that the FJA planned to celebrate World IP Day (April 26) at the close of CLDP’s IP segment.  At the World IP Day celebration, the keynote speaker, Lahore High Court Justice Muhammad Farrukh Irfan Khan, discussed the importance of judicial enforcement of intellectual property rights to Pakistan’s economic development and praised CLDP's program.

The Honorable Delissa A. Ridgway, U.S. Court of International Trade, commenced her International Commercial Arbitration segment on April 27 but was not able to finish her program due to unforeseen personal circumstances. CLDP finished the program strong, and Justice Jan, in noting the success of the program, asked for further CLDP technical assistance.  At the conclusion of the program, Judge England and Judge Ridgway were interviewed by the following print media regarding the program: The Daily Times, The News, International News Network and the Frontier Post.  CLDP will continue to work with the Pakistan Supreme Court and FJA to design sustainable programs that will build the Pakistani judiciary’s capacity to adjudicate IP and international commercial arbitration cases in a consistent and transparent manner.
